I received 2 1099-C’s for debt settlements (personal loan & credit card) total of approx. $16,000. It looks like filing a Form 982 for insolvency would give me about $2,500 more in refund. How complicated is it to file for insolvency? Do I need an attorney? Is it more involved than just filing the Form? I am trying to decide if it’s worth it. I always do my own taxes except if I file for insolvency I would have to pay someone to do the taxes. Any help would be appreciated.

You show up at a foreclosure sale with a certified check as required in the notice (usually $5,000 or $10,000), if you want to bid. My ex and I got a joint credit card shortly before we got married. We filed for a summary dissolution last year and at the time, the credit card balance was under the 6 grand that is the max amount of debt you can have together based on California law. In oru property settlement agreement, we signed off on it by saying that husband and wife will pay off the joint credit card jointly until it is paid off. Upon final payment, account will be closed out. Since then more charges have been put on it until it finally got closed out. Now there is a balance on it over 6 grand and he refuses to pay on it. I’m paying on it alone and I’m wondering… Because the property settlement agreement didn’t say how much each would pay or that it would be split in half, if he just pays one cent, does that mean he did his part and I have to pay the rest? Is it illegal to have put more charges on it after the filing? Or do you just need to meet the debt max amt at filing time?
