Yes,do this first.Because you will need a place to stay.this should not affect your filing.
It depends on what you want to do and if you have the money to move in to a rental right away. Have you received a foreclosure notice yet on your home? Some of my clients stay in their homes without paying their mortgage/rent until the home is foreclosed on. This allows them several months in the home to save money for a new place. True, your credit will be better if you do it beforehand, but often times apartments or landlords will just want a letter from your attorney stating that you cannot include them in your bankruptcy. Your attorney’s office should be more then willing to do this for you if you need it. Feel free to email me if you have any other questions
Your best advice will come from an attorney because the laws to bankruptcy have changed and you may not qualify for bankruptcy. If you do, it could be either Chapter 7 or 13. When the court reviews your budget, you may or may not be allowed to file. The review goes back six months in terms of gifts, loans, payments, etc. and is effective on the day you file. Then you wait for approval, court apperance, etc. It’s a very emotional process and its your reputation that is shot. If you know that giving up your home will help free up your budget, then maybe bankruptcy isn’t for you. Look at all of your options but realize that it’s the court that decides what you can and cannot do… not you. Again, legal counsel from a qualified attorney is what you need right now. Every case is different. For you a credit counseling agency might help you more than bankruptcy if you are going to end up repaying the debts anyway. Get the facts!
Just make sure that the price is within your income. I have been through it.
